Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the JobPulse website, web application and related services (the "Service"), operated by Innovefy LLC, 6000 Metrowest Blvd #200, Orlando, FL 32835 ("JobPulse," "we," "us"). By creating an account, starting a trial or using the Service, you agree to these Terms. If you use the Service on behalf of a company, you represent that you have authority to bind that company ("Customer").
2. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for your account credentials, for all activity under your account, and for the users you invite (employees, subcontractors and clients). Notify us immediately at hello@jobpulsebuild.com of any unauthorized use.
3. Free Trial, Subscriptions and Automatic Renewal
Plans: Starter US$29/month, Pro US$59/month, Enterprise US$99/month, billed monthly; additional users US$7/user/month and extra storage US$0.70/GB where offered. All plans include a 3-day free trial. No payment method is required to start the trial. Billing starts only when you activate a paid plan, which you can do at any time during the trial. ONCE YOU ACTIVATE A PAID PLAN, YOUR PAYMENT METHOD WILL BE CHARGED THE PLAN PRICE ON THE DAY OF ACTIVATION AND YOUR SUBSCRIPTION WILL RENEW AUTOMATICALLY EACH MONTH UNTIL YOU CANCEL. If no paid plan is activated by the end of the trial, the trial account and all of its data are deleted. Payments are processed by Stripe. Prices exclude applicable taxes. We will notify you in advance of any price change, and changes take effect at your next renewal.
4. Cancellation and Refunds
You can cancel at any time online from the Billing screen in the app, or by emailing hello@jobpulsebuild.com. Cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods. Add-on AI credit packs are non-refundable. Unused add-on credits do not expire while your account is active, and are removed when the account is deleted. Monthly plan credits renew each month and do not roll over.
5. Acceptable Use
You agree not to: (a) violate any law or third-party right; (b) upload malicious code or attempt to breach security; (c) reverse engineer, resell or sublicense the Service; (d) use the Service to send spam; or (e) track individuals' location without their knowledge and any consent required by law.
6. Customer Data and Employee Location
You own the data you and your users submit, including job records, photos, documents, time entries and GPS location ("Customer Data"). You grant us a limited license to host and process Customer Data only to provide and improve the Service, as described in our Privacy Policy (/privacy). If you use GPS time tracking, you are responsible for notifying your workers and obtaining any consent required by applicable law, and for using location data only for lawful work purposes.
7. Quotes, Contracts and Electronic Signatures
The Service lets you send quotes and contracts and collect electronic signatures and approvals from your clients. You are solely responsible for the content, pricing and legal validity of your documents and for your relationship with your clients. JobPulse is not a party to any agreement between you and your clients and does not provide legal, tax or accounting advice.
8. Third-Party Services
The Service integrates with third-party services (such as Stripe and Google Maps). Your use of those services is governed by their own terms, and we are not responsible for them. JobPulse lets you export reports as CSV files formatted for common payroll and accounting tools. We do not send your data to those services; you choose whether to upload the files yourself.
9. Intellectual Property
The Service, including software, design, logos and the JobPulse name, is owned by Innovefy LLC and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. Feedback you provide may be used by us without obligation.
10. Availability and Changes
We work to keep the Service available but do not guarantee uninterrupted operation. Offline features sync when a connection is restored, and you are responsible for keeping your devices connected for syncing. We may modify features from time to time.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INNOVEFY LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
13. Indemnification
You will defend and indemnify Innovefy LLC against claims arising from your Customer Data, your documents and contracts with your clients, your treatment of your workers' data, or your violation of these Terms.
14. Termination
You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms or remain unpaid. After cancellation, the account admin can download the Customer Data from the Billing screen in the app for 30 days after access ends. This in-app download is the only way we provide an export. After those 30 days, Customer Data is permanently deleted. We keep only basic records of your JobPulse subscription (company name, tax ID, billing contact, plan, invoices, payments and terms acceptance) for 7 years for accounting, tax and legal purposes, then delete them. Invoices and other records you created for your own clients are Customer Data and are deleted.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Orange County, Florida, and you consent to their jurisdiction.
16. Changes to These Terms
We may update these Terms. If changes are material, we will notify you by email or in the app at least 15 days before they take effect. Continued use after the effective date means you accept the updated Terms.
